These Terms and Conditions set out the basis on which Waste Clearance Watford provides waste clearance and related services to residential and commercial customers. By booking a collection or using any of our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

1. Definitions

In these Terms and Conditions, the following expressions shall have the meanings set out below:

Customer means any individual, business or organisation that requests or receives services from Waste Clearance Watford.

Services means any waste clearance, collection, removal, loading, transportation, disposal, recycling or related services provided by Waste Clearance Watford.

Waste means any rubbish, junk, household waste, commercial waste, garden waste, bulky items and other materials presented to us for collection, subject to restrictions set out in these Terms and Conditions.

Booking means an order, request or appointment for Services placed by the Customer and accepted by Waste Clearance Watford.

Contract means the agreement between Waste Clearance Watford and the Customer for the provision of Services, comprising these Terms and Conditions and the confirmed Booking details.

2. Scope of Services

Waste Clearance Watford provides waste removal and clearance services within our operational service area, which is focused on Watford and surrounding locations. The exact nature of the Services, including type and volume of Waste to be collected, access requirements, timing and any additional work, will be agreed at the time of Booking or upon arrival at the collection address.

We reserve the right to refuse to collect certain items or materials if they are prohibited, hazardous, illegal, improperly packaged, unsafe to handle or outside the scope of our licence or capabilities. We may also refuse or adapt the Services where there is a health and safety risk to our staff, the public or property.

3. Booking Process

3.1 Customers may request a Booking by telephone, email or other agreed communication method. You will be asked to provide details such as your name, contact information, collection address, description of Waste, approximate volume or number of items, access details and preferred collection time and date.

3.2 Any quotation given prior to the physical inspection of the Waste is an estimate only, based on the information supplied by the Customer. The final price may vary depending on the actual volume, weight, type of Waste, access conditions and any additional work required.

3.3 A Booking will be confirmed when Waste Clearance Watford accepts your request and provides confirmation of the date, estimated time slot and indicative price. We may request a deposit or card details to secure the Booking.

3.4 The Customer warrants that all information provided in connection with the Booking is accurate and complete. If the information is inaccurate or incomplete, we may adjust the price, vary the Services or cancel the Booking.

4. Access and Customer Responsibilities

4.1 The Customer is responsible for ensuring that our team has safe, reasonable and unobstructed access to the collection point at the agreed time. This includes arranging any necessary parking, permits, gate codes, lifts or access instructions.

4.2 The Customer must ensure that the Waste to be collected is clearly identified, separated from items not intended for removal, and presented in a safe condition for handling. Fragile items, sharp objects and loose materials should be secured or suitably contained.

4.3 If our team is unable to gain access, is delayed due to access issues, or is unable to safely carry out the Services because of Customer default, we may charge a call-out fee and any reasonable waiting time, or treat the Booking as cancelled by the Customer.

4.4 The Customer warrants that they either own the items and Waste presented for removal or have full authority from the owner to arrange their removal and disposal. The Customer agrees to indemnify Waste Clearance Watford against any claims from third parties concerning ownership or authority.

5. Pricing and Payments

5.1 Prices are normally calculated based on the volume and type of Waste, the time required on site, labour involved, any special handling requirements, disposal fees and travel within our service area. We will explain our current charging structure at the time of Booking or upon arrival.

5.2 Unless otherwise agreed in writing, payment is due immediately upon completion of the Services. We may accept cash, card or other electronic payment methods as advised at the time of Booking.

5.3 For business Customers, we may agree alternative payment terms, subject to credit checks and written confirmation. Failure to pay within the agreed period may result in interest charges at the statutory rate, together with any reasonable recovery costs.

5.4 All prices quoted are exclusive of any applicable taxes unless expressly stated otherwise. If taxes apply, they will be charged at the prevailing rate.

5.5 If the volume or nature of Waste on arrival exceeds that originally described by the Customer, or if additional services such as extra labour, dismantling, or specialist handling are required, we may revise the price before proceeding. If you do not agree to the revised price, we may cancel the Booking and charge a reasonable call-out fee.

6. Cancellations and Amendments

6.1 The Customer may cancel or amend a Booking by giving Waste Clearance Watford reasonable notice. Unless otherwise stated, we ask for at least 24 hours notice for cancellations or major changes.

6.2 If the Customer cancels with less than 24 hours notice, we may charge a late cancellation fee to cover administration, scheduling and any travel costs already incurred.

6.3 If our team attends the collection address at the agreed time and is unable to carry out the Services due to Customer default, including failure to provide access or incorrect information about the Waste, we may charge a call-out fee and any associated costs.

6.4 Waste Clearance Watford may need to reschedule or cancel a Booking due to circumstances beyond our control, such as extreme weather, traffic disruption, vehicle breakdown, staff illness or regulatory issues. We will notify you as soon as reasonably practicable and agree a new time, but we shall not be liable for any resulting loss or inconvenience, subject to the limitations set out in these Terms and Conditions.

7. Waste Types and Regulations

7.1 Waste Clearance Watford operates in accordance with relevant UK waste management legislation and regulations. We are committed to lawful, safe and environmentally responsible handling, transport and disposal of Waste collected within our service area.

7.2 Certain types of Waste are restricted or prohibited, including but not limited to asbestos, clinical or medical waste, certain chemicals, solvents, oils, fuels, pressurised containers, gas bottles, explosives, radioactive materials, and any other hazardous or controlled waste for which we are not licensed or equipped.

7.3 If hazardous or prohibited Waste is discovered within a load after collection has begun, we may refuse to remove it, separate it from the rest of the Waste where safe to do so, or return it to the Customer. We may also charge additional fees for any extra handling, storage, testing or specialist disposal required.

7.4 The Customer is responsible for informing us in advance of any items or materials that may be hazardous, fragile, unusually heavy, difficult to access or otherwise require special handling. Failure to provide accurate information may result in additional charges or cancellation of the Services.

7.5 We aim to divert as much collected Waste as reasonably practicable from landfill through reuse and recycling. However, no guarantee is given that any particular item or proportion of Waste will be recycled, as this depends on local facilities, regulations and material composition.

8. Service Standards and Timeframes

8.1 We will take reasonable care and skill in providing the Services, including when operating at busy times throughout the Watford area and surrounding regions. Timeframes for arrival and completion are estimates only and may be subject to delays.

8.2 While we make reasonable efforts to arrive within the agreed time slot, we cannot guarantee exact arrival times. Factors such as traffic, roadworks, weather conditions and previous jobs may affect timing.

8.3 If we anticipate being significantly delayed, we will attempt to notify the Customer and provide an updated estimated time of arrival. This shall be the Customer's sole remedy in respect of delays, subject to the limitations of liability set out below.

9. Damage, Liability and Insurance

9.1 Waste Clearance Watford will exercise reasonable care when carrying out the Services. However, the Customer acknowledges that the nature of waste clearance work may involve moving heavy or awkward items through restricted spaces, and that minor scuffs or marks to walls, floors or doorways may occur.

9.2 The Customer should take reasonable steps to protect property, including removing or covering fragile items, protecting flooring, and advising our team of any particular risks or vulnerabilities at the premises.

9.3 Waste Clearance Watford shall not be liable for any pre-existing damage or for any damage that could not reasonably have been avoided during the normal and careful performance of the Services.

9.4 To the fullest extent permitted by law, our total liability to the Customer for any loss or damage arising under or in connection with the Contract, whether in contract, tort, negligence or otherwise, shall be limited to the total price paid or payable by the Customer for the specific Booking giving rise to the claim.

9.5 We shall not be liable for any indirect or consequential loss, loss of profit, loss of business, loss of opportunity or loss of data, whether foreseeable or not, arising out of or in connection with the Services or these Terms and Conditions.

9.6 Nothing in these Terms and Conditions shall limit or exclude liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded.

10. Items of Value and Title to Waste

10.1 Once items or materials have been removed from the premises by Waste Clearance Watford, they are treated as Waste and the Customer relinquishes all title, rights and interest in them, unless otherwise expressly agreed in writing.

10.2 The Customer must remove any items of sentimental, personal or monetary value before the collection starts. We accept no liability for loss of such items once they have been presented to us as Waste.

10.3 We may, at our discretion, separate items suitable for reuse, re-sale or donation. Any proceeds from such activity shall belong solely to Waste Clearance Watford and shall not affect or reduce the agreed price for the Services.

11. Complaints and Disputes

11.1 If you are dissatisfied with any aspect of our Services, you should notify us as soon as possible, and in any event within 48 hours of completion of the Services. We may request photographs, a description of the issue and access to the premises to assess the situation.

11.2 We will investigate complaints in a fair and timely manner and may offer a remedy where appropriate, which could include re-attendance, partial refund or another reasonable solution, at our discretion and subject to the limitations of liability set out in these Terms and Conditions.

11.3 If a dispute cannot be resolved directly between the parties, either party may pursue its rights through the courts as provided for under governing law.

12. Data Protection and Privacy

12.1 Waste Clearance Watford will collect and process personal data such as names, contact details, addresses and payment information only for the purposes of managing Bookings, providing Services, handling payments, and fulfilling legal obligations.

12.2 We will take reasonable steps to keep personal information secure and will not sell or share it with unrelated third parties except where necessary to provide the Services, process payments, comply with legal obligations or enforce our rights.

13. Changes to These Terms and Conditions

13.1 Waste Clearance Watford may update or amend these Terms and Conditions from time to time to reflect changes in law, industry practice, operational requirements or our services.

13.2 The version of the Terms and Conditions in force at the time of your Booking will apply to that Contract. You should review the Terms and Conditions periodically to ensure that you understand the current provisions.

14. Governing Law and Jurisdiction

14.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

14.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions, the Contract or the provision of our Services.

15. General Provisions

15.1 If any provision or part-provision of these Terms and Conditions is held to be invalid, unlawful or unenforceable, it shall be deemed deleted, but that shall not affect the validity and enforceability of the rest of the Terms and Conditions.

15.2 No failure or delay by Waste Clearance Watford in exercising any right or remedy under these Terms and Conditions or by law shall be deemed a waiver of that or any other right or remedy.

15.3 The Customer may not assign, transfer or subcontract any of their rights or obligations under the Contract without the prior written consent of Waste Clearance Watford. We may assign or subcontract our rights and obligations where reasonably necessary to deliver the Services.

15.4 These Terms and Conditions constitute the entire agreement between Waste Clearance Watford and the Customer in relation to the Services and supersede any prior discussions, correspondence or understandings.
